Judicial Summary

The First-tier Tribunal gave insufficient reasons for rejecting evidence relied on by a parent in support of a particular social care recommendation. In so far as it related to special educational matters, the First-tier Tribunal鈥檚 decision was free of legal error. The Upper Tribunal did not set aside the First-tier Tribunal鈥檚 decision. In declining to set aside, the Upper Tribunal took into account, amongst other matters, that a local authority is not required to accept a social care recommendation made by the First-tier Tribunal but is required to arrange any special educational provision ordered by the tribunal.
